Fireworks: what Florida law allows
Section 791.08 of the Florida Statutes names three designated holidays when consumer fireworks may be used: New Year’s Day, Jan. 1; Independence Day, July 4; and New Year’s Eve, Dec. 31. The law says:
- It does not supersede local government regulation of fireworks.
- A ban on fireworks in a recorded homeowners association covenant still applies, but an HOA board cannot adopt its own rules that take away a homeowner’s right to use fireworks on a designated holiday.
In practice: check your HOA’s recorded covenants before you light anything, keep fireworks away from dry brush, pets and people, and soak used fireworks in water before they go in the trash. The Fourth of July rules and the town’s show are on our Fourth of July fireworks page.
